Terms & Conditions

By purchasing a photo shoot/photo products with Lunar Photography you enter into the following terms:

1. Any photographs taken by Lunar Photography may be used by Lunar Photography for marketing material & competition entries/qualifications. Lunar Photography also has the right to supply their own material to third parties, such as for commercial use, unless specifically requested otherwise by the customer.

2. All photo shoot clients will be subscribed to the mailing list—you can unsubscribe at any time.

3. All final images shall be viewed via private viewing session in person - unless circumstances require the gallery to be uploaded to a private gallery on my website for viewing. This will be password protected.

4. The customer understands that public events gallery images have undergone a base edit only, and only purchased images will be fully edited.

5. Gallery passwords may be shared among friends/family. However, “screen shotting”/downloading the image without purchasing the JPEG first is NOT PERMITTED. You will be billed for using an image without permission, and asked to remove the image until you have purchased it.

6. Digital files will be emailed to the customer:

For public events & clinic galleries within 7 working days of receiving payment. Any prints will be delivered to the customer either in person or via post within 3 weeks of the date of order. Any delays will be communicated by Lunar Photography.
For private photo shoot clients, within 7 working days of placing your order after your photo shoot has taken place OR receiving payment for extra digital files purchased. Digital files purchased at a viewing may be put onto a USB immediately if requested.

7. Once a low resolution/web file is purchased, customers have permission to share as desired across social media etc. But NOT permission to have these printed or to edit these files in any way, including instagram filters, black and white etc. You may be asked to take these down, as this is not a true representation of my work, and goes against copyright law.

8. Any extras ordered via email will be invoiced separately and won’t be processed until payment is received.

9. Private viewings of your final gallery are available in person or via zoom

10. Gift cards/E-gift cards expire after 12 months—the date of expiry is recorded in my records. They can not be refunded/exchanged. They also can't be used in conjunction with any other offers, unless my consent is given. See more about my gift card terms below.

11. Photo shoots normally last 2 hours, but there is no specific time limit.

12. Photo shoot prices include UP TO 4 horses and/or dogs. If you have anymore than that please make Lunar Photography aware as the original price may be adjusted.

13. Photo shoot prices also include up to THREE outfit changes, any extra outfit changes must be agreed prior to the photo shoot starting and prices may be adjusted accordingly.

14. Photo shoots will take place at a location mutually agreed by Lunar Photography and the customer. The customer is responsible for obtaining permission to use their requested location.

15. Lunar Photography does not take responsibility for any damages or loss of life to any persons, animals or property participating in the photo shoot. This includes the customer and anyone else on location.

16. The customer agrees that they participate in the photo shoot at their own risk, and any suggestions/requests are well within their/their horse/their dogs’ ability.

17. The customer agrees that all dog/horse behavioural issues have been disclosed to Lunar Photography prior to the photo shoot.

18. Private online galleries will be removed after 4 weeks unless otherwise requested by the customer. Galleries can be put back up after the period if you wish to purchase more images, however this will incur a £20 admin fee.

19. I reserve the right to update my terms & conditions at any time.

20. I reserve the right to change my prices at any time.

21. Purchasing a photo shoot or photo products shows that you have read and agreed to the terms and conditions stated here.

22. Lunar Photography reserves the right not to commence a photo shoot until FULL payment for the photo shoot package has been received.

23. Should you request your images are no longer shared publicly by Lunar Photography, please send a written email of your request to imogen@lunarphoto.co.uk - your request will be acknowledged and fulfilled within 28 working days of acknowledgment.

24. It is the owners responsibility to ensure all horses/dogs have the correct insurance to cover them out in public.

Refunds, Cancellations & Booking fees

1.You have the right to cancel within 14 days of paying your booking fee. If you pay your booking fee less than 14 days in advance of your photo shoot, this does not apply. After 14 days the booking fee is non-refundable.

2. A £100 NON REFUNDABLE booking fee MUST be paid to secure your chosen date.

Bookings are secured by payment, failure to make payment will mean that your photo shoot slot is not secured and may be rebooked by another customer.

3. Should cancellation by Lunar Photography be necessary, this will be communicated as soon as possible. If unforeseen circumstances should occur, Lunar Photography will reschedule for a time to suit both parties.

4. Should weather conditions be deemed unfavourable (upon mutual agreement between Lunar Photography and the customer), photo shoots may be rescheduled to suit both parties. This is due to expensive equipment not being waterproof and the adverse effect on the quality of the photo shoot. Any concerns regarding the weather will be communicated as soon as possible. There is no extra charge for rescheduling for this reason. If the weather is unfavourable and we agree to go ahead with the photo shoot, there is no guarantee for the quality of the photos. Should the shoot go ahead in unfavourable weather conditions, please not the quality of work may be limited/affected.

5. Rescheduling for reasons other than unfavourable weather, illness, loss of life to you or your horse/dog will incur a £50 rescheduling fee.

6. If you need to reschedule for any other reason, please let me know no later than 7 days before your photo shoot, failure to do this will incur a £50 rescheduling fee.

7. Should you CANCEL your photoshoot after 14 days since booking your chosen date, any moneys paid MINUS the £100 booking fee will be refunded.

Just so you know… If you have any specific images/requests in mind for your photo shoot, please contact Lunar Photography at least 24 hours prior.

It is possible to get different size prints/ products should you wish, so please don’t be afraid to request something. If the request is not within my ability I will let you know. GIFT VOUCHERS

This information is in addition to my standard terms and conditions above.

1. Vouchers and gift cards are valid for a year from purchase.

2. Gift cards/vouchers can NOT be replaced if lost/stolen/destroyed.

3. Gift cards/vouchers can NOT be exchanged for cash or other denominated vouchers.

4. If an intended purchase is for a higher amount than the face value of the gift card/voucher, then the difference must be made up with a credit card/ cash payment. If it is less, change will not be given.

5. Gift cards/vouchers can NOT be used in conjunction with any other special promotions or discount vouchers.

6. Gift cards/vouchers can NOT be sold to third parties without consent. If consent is given the purchase may be subject to any conditions which we impose. In any extent you may NOT sell vouchers through the internet without our written consent, which you must obtain before making the sale. We reserve the right at all times to refuse permit of any sale of gift cards/ vouchers by you to a third party.

7. Gift vouchers can only be used towards the value of a full photoshoot/additional products purchased at the photoshoot viewing, unless specifically stated otherwise.

The In Person Viewing Session

1.You will be required to sign off and confirm all information on the order form at the end of your viewing session. Please make sure all the information is correct as this will be final.

2. Digital files will be uploaded onto a private online gallery within 7 days of your order. You may request a USB at the viewing - in this case the files will be uploaded onto the USB at the viewing session if in person, or posted to you if online/via video link.

3. Frames & prints will be ready and delivered within 4 weeks of order.

4. Albums will be ready and delivered within 6 weeks of order.

5. In person viewing sessions take approximately 2 hours.

6. You may collect your order from me, or have it delivered directly to your chosen address. There is a £25 delivery fee.

7. Payment for any products ordered must be done at the time of in person/video viewing session - the client understands that payment options may be available upon discussion, but products will not be delivered until full payment has been received by Lunar Photography.

8. You can make payment via cash, credit/debit card or bank transfer at your viewing session.

9. Any orders once paid for are final and will not be refunded/changed at a later date.

10. If you are not happy with any products received, please speak to me and we can work together to get any issues sorted for you.

11. If you decide to print your files yourself, I can not guarantee the quality of the finished product.

What you can and can’t do with your images...

Personal Photo Shoot Clients

Absolutely NO screen shotting from your final gallery is allowed.
High resolution images may be printed.
You may not adjust the image in any way, for example, add an instagram filter, change it to black & white (if you want an image in black and white, please let me know, I can do this for you!), crop the image etc.
You may NOT use the photo for a competition without my permission first (for example, a Facebook giveaway that requires use of a photo in exchange for a free gift).
You may NOT send it to other brands/companies for them to use without my permission first.
If my permission is granted for the image to be used elsewhere, the other company MUST tag/credit me when sharing the image.
You may share your gallery link & password with as many family members/friends as you wish, but the above rules apply to them.
Any breach of the above will result in me billing you appropriately for the use of the images. A high resolution file costs £79.
Please notify me if you DO NOT want me to share your images online, I often use images across my social media and website in my portfolio and on my sales pages etc. Unless you notify me, I will assume you are happy for me to do this.

Business Photo Shoot Clients

Please do not screen shot from your gallery - you can download the original image from your gallery, or I will have sent them all to you on a USB/via WeTransfer. Screen shotting will result in the quality of your image being compromised.
You may use your images in print, publications, websites, online marketing materials, social media etc as you have purchased the license for this.
You MAY NOT sell my images to a third party, the images are for your business use only.
I will not sell your images to third parties as stock imagery or fine art without your permission first.
You may not adjust the image in any way, for example, add an instagram filter, change it to black & white (if you want an image in black and white, please let me know, I can do this for you!), crop the image etc.
Please notify me if you DO NOT want me to share your images online, I often use images across my social media and website in my portfolio and on my sales pages etc. Unless you notify me, I will assume you are happy for me to do this.

Event Photography Clients

Absolutely NO screen shotting from the event gallery is allowed.
Once you have purchased your images, social media files may be shared online as you wish, but you DO NOT have the license to print these images. I’d love it if you tagged me in them so I can share them, too!
You may not adjust the image in any way, for example, add an instagram filter, change it to black & white (if you want an image in black and white, please let me know, I can do this for you!), crop the image etc.
You may NOT use the photo for a competition without my permission first (for example, a Facebook giveaway that requires use of a photo in exchange for a free gift).

Unauthorised use of my images is classed as THEFT. As the creator of my images they are legally my property and protected under copyright law. If you’re unsure about something, please contact me first. I will do my best to work with you so you can get the full use out of your images as you wish.

Competition Terms & Conditions

Introduction

By participating in the competition you are agreeing to these competition terms and conditions.The competition is being run by Lunar Photography/Imogen Moon.

Eligibility to Enter

The competition is open to entrants over 18 years of age - if you are under 18 years of age you must have an adults permission. Lunar Photography/Imogen Moon employees and associates are excluded from the draw.

By entering the competition, you confirm that you are eligible to do so and that you are eligible to receive any prizes that may be awarded to you.

There is a limit of one entry per person and the competition is completely free to enter.

The Prize

The winning prize will be Photoshoot/voucher towards a photoshoot, please see entry form for specific details on each individual giveaway.

The use of specific brands as prizes by Lunar Photography/Imogen Moon does not imply any affiliation with or endorsement of such brands.

The prize is non-transferable and non-exchangeable, and no cash alternatives will be provided.

We reserve the right to substitute prizes of equal or greater value if circumstances beyond our control require doing so.

Lunar Photography/Imogen Moon's decision on any aspect of the competition is final and binding, and no correspondence will be entered into about it.

A £100 refundable booking fee may be required to secure your chosen photoshoot date, this will be refunded at your viewing session, or you can use this to purchase extra images/photo products at your viewing.

Winner Announcement

The winner will be chosen at random and notified via the email address provided on the stated date of the winner being announced for the competition.

Lunar Photography/Imogen Moon will make two attempts to contact the winner via email.

If the winner does not respond to the emails informing them of their win within 14 days of the second email, they forfeit their right to the prize, and Lunar Photography/Imogen Moon reserves the right to select and notify a new winner.

Delivery of the Prize

The winner will allow 14 days for the prize to be delivered, otherwise alternative collection or delivery arrangements can be made through mutual agreement. The Photoshoot voucher/prize will remain valid for 6 months - please see competition entry form for specific date of expiry.

Data Protection and Publicity

You agree that any personal information that you provide when entering the competition will be used by Lunar Photography/Imogen Moon for the purposes of administering the competition and for the other purposes as specified in our Privacy Policy.

All entrants may request information on the winning participant by emailing imogen@lunarphoto.co.uk.

If requested by Lunar Photography/Imogen Moon, the winner agrees to release their first name/surname to any other competition participants.

The winner's first name and surname will be announced on Lunar Photography/Imogen Moon's website and social media channels.

Limitation of Liability

Lunar Photography/Imogen Moon accepts no liability for any damage, loss, injury, or disappointment suffered by any entrants as a result of participating in the competition or being selected for a prize.

General

Lunar Photography/Imogen Moon reserves the right, at any time and without prior notice, to cancel the competition or amend these terms and conditions.

We will make it as easy as we can for you to opt out of unwanted processing, providing it does not restrict our ability to provide you with the primary service you have requested.

We use website analytics to provide the best user experience and service to you and to evaluate and improve our site. We utilise third party data analytics service providers Google analytics to improve our visibility and to monitor website browser behaviour and navigation across our site.

Terms and Conditions of Sale

Introduction

These Terms of Purchase set out how you (the User) can make purchases from our Site. Please read them carefully. We pride ourselves in providing a high level of customer service and ensuring that you are clear in respect of all of your rights relating to your purchase. Ahead of making any purchase you will be asked to tick a box on our Site which says “I Accept the Terms and Conditions of Sale”. In ticking that box, you will be accepting the terms set out here.

We are based in the UK and our Terms of Purchase are governed by UK legislation. We DO NOT offer international shipping and our digital documents can be downloaded worldwide.

It is always our aim that you will be fully satisfied with your purchase. Should you have any questions about your purchase we will be happy to assist.

Purchase Terms for Services

The details of each specific service and the terms of delivery associated with it are described on each page of the website and delivered in accordance with these terms. You should review those terms in detail before purchasing.

If you purchase as a consumer, rather than a business, then should you change your mind following your purchase you are entitled to a refund within the first 14 days. Should you receive any element of the service prior to requesting a refund then any refund will be issued pro-rata for the services provided.

Purchase Terms for Non-Customised Products and Digital Downloads

We are proud of our photos and the results which our clients achieve from them. If you buy digital photo files you are purchasing a digital JPG file which you will receive via email once your payment & order has been processed. You can then download and save to your device. As you receive this file within 24 hours you will not be entitled to receive a refund so do check that you are purchasing the correct product or service to meet your needs. Your other statutory rights to a refund remain in place in the usual way.

Please be advised that we reserve all rights to our intellectual property for both our customised and non-customised products and services. This means that whilst you are free to use the download digitally or print out a copy for personal use you are not permitted to copy, distribute, adapt, edit or share any of our products with third parties.

Purchase Terms for Products

We have worked hard to create products of high quality. For the individual detail and specification of each product, please see the product description which accompanies each product listing. Please note that we take all reasonable steps and care to ensure that all details, product descriptions and prices of products are accurate. Although we aim to keep this Site as up-to-date as possible, the information available on the Site may not reflect the availability position at exactly the moment you place an order.

Images of products on our Site are for illustrative purposes only. We make every effort to ensure that images are captured and displayed accurately but we cannot guarantee that the products are displayed accurately on your device. The products that you order and the packaging of the products may vary from the images on the Site.

Cancellation Rights

As a consumer purchasing online you have the legal right to cancel your order with us. Your right to cancel begins on the date you place your order and ends 14 calendar days form the day after you receive the product.

You need not provide a reason for cancelling your order; however, you must email us at imogen@lunarphoto.co.uk to cancel your order. Where possible please include your order number in the correspondence. We will then respond by email to confirm that we have received notification of cancellation.

In circumstances where you have already received your products. You will be required to package up the item and return it at your own cost. All products must be returned in their original packaging and condition, plus any additional packaging for returns. We reserve the right to reduce the amount of any refund offered to reflect any reduction in the value of the product which is caused by the way it is handled or returned by you. Following receipt of the returned products we will arrange for a refund to be returned to the card used for the purchase. Please allow up to 14 days for the refund to show on your bank statement. You will receive a refund for the price paid for the product and the original delivery charges but you will not receive a refund for the cost of returning the product to us.

You must return the products within 14 days of the cancellation being confirmed. Return items should be sent to:

If we have not yet dispatched the product before you cancel then we will process your refund within 14 days of your cancellation.

If you only cancel the order in respect of some and not all of the products ordered then you will not receive a refund in respect of the delivery charges.

Exclusions

Please note that whilst we provide refunds in accordance with the Consumer Contracts (information, Cancellation and Additional Charges) Regulations 2013, as set out above, as permitted by that legislation, we are unable to accept refunds of the following:

Items which cannot be returned for health and hygiene reasons, unless the returned to us unused and in a fully resealable condition with all hygienic seals in place and unbroken;
Items which are personalised or made to your specification;
Products which are liable to deteriorate or expire rapidly.

Faulty Goods

Nothing in these terms affects your legal rights in respective of products which are defective or not as described.

If you think a product is defective or mis-described then please email Imogen Moon at imogen@lunarphoto.co.uk with a detailed description of the fault and, if possible, photographs of any wear and tear or similar damage to the products.

All returns made as potentially defective will be examined once they have been received by us and we will notify you via email to confirm if you are entitled to a refund. Faulty goods will be replaced with a like for like replacement where possible. If you are entitled to a refund this will be provided within 30 days of when we notify you via email that you are entitled to a refund. If you are entitled to a refund as a result of a defective product, you will receive a full refund of the price paid for the product, the original delivery charges and the cost of returning the product to us.

Pricing

The prices are as quoted on the website for each item. Prices do include VAT. The product pricing also excludes delivery charges which will be added to the total amount at the checkout.

We may change our prices at any time but changes will not affect any order in respect of which we have already sent you an order confirmation.

It is always possible, despite our best efforts, that some products listed on our Site may be incorrectly priced. We will normally check prices as part of our dispatch procedures so that, where a product's correct price is less than our stated price, we will charge you the lower amount when dispatching the product to you. If a product's correct price is higher than the price stated on our Site, we will contact you to inform you of the error and give you the option of either continuing your purchase of the product at the correct price or cancelling your order. If we are unable to contact you using the details you provided during the order process, we will treat your order as having been cancelled and notify you in writing. We are under no obligation to provide any product to you at an incorrect (lower) price if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mis-pricing.

Delivery

Unless you are purchasing an item on pre-order or a bespoke customisation (where in such circumstances an estimated delivery date will be provided) delivery will take place within 15 calendar days of the date of the order confirmation. Our orders are usually sent out as soon as your printed product is ready (within 2 weeks of order) via Parcel Force 48 hours or similar and should reach you within a 21 day period.

If we do not deliver your product within 21 calendar days or within the other time period agreed between us, you may contact us to cancel your order. We are not responsible for delays outside of our control. We will contact you as soon as possible to let you know of any delay which may occur to your order and we will take steps to minimise the effect of the delay.

If you provide to us any instructions relating to the delivery of your order (including, without limitation, instructions to leave the products in a particular place, outhouse or with a neighbour), you are responsible for ensuring the accuracy of these instructions and we shall not be liable to you in relation to any loss of or damage to the product resulting from our following of your instructions. Delivery will be complete when we deliver the product to the address you gave us or in accordance with your other instructions.

Warranty and Liability

We warrant to you that any product purchased from us will, for at least a period of six months from the date of delivery, be of satisfactory quality, free from material defects and reasonably fit for all the purposes for which products of the kind are commonly supplied.

We will not be liable for any defect in the product arising from fair wear and tear, failure by you to follow specific care instructions, wilful damage, abnormal storage, accident, negligence by you or any third party or any alteration or repair made by you or a third party.

Our liability for any losses you suffer as a result of us breaking these terms is limited to the purchase price of the product you purchased and any losses which are a foreseeable consequence of us breaking these terms. Losses are foreseeable if they are an obvious consequence of a breach or they were contemplated by you and us at the time the purchase was made.

We do not exclude or limit in any way our liability:

For death or personal injury caused by our negligence;
Under section 2(3) of the Consumer Protection Act 1987;
For breach of the terms implied by sections 12 to 15 of the Sale of Goods Act 1979;
For fraud or fraudulent misrepresentation; or
For any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.

We only supply products for domestic and private use and you agree not to use any products for commercial, business or re-sale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.

Should you consider that you have grounds to obtain a refund which are not set out above you should email imogen@lunarphoto.co.uk to set out your refund request.

All refunds are provided in accordance with your statutory rights.

Law and Jurisdiction

These terms and any claim or dispute arising in relation to any purchase will be governed by English law. You and we agree that the courts of England and Wales shall have non-exclusive jurisdiction to settle any such claim or dispute.

Notwithstanding any of these terms, we do not intend to exclude or limit our liability to you where it would be unlawful to do so. We do not exclude or limit liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

We have no liability to You for any loss of profit, loss of business, business interruption or loss of business opportunity. To the maximum extent permissible at law, our aggregate liability to you in connection with these terms howsoever arising in contract, negligence or otherwise, is limited to £250.

If defective digital content that we have supplied damages a device or digital content belonging to you and this is caused by our failure to use reasonable care and skill, we will either repair the damage or pay you compensation.

Refunds, Cancellations & Booking fees

2. A £100 NON REFUNDABLE booking fee MUST be paid to secure your chosen date.

Bookings are secured by payment, failure to make payment will mean that your photo shoot slot is not secured and may be rebooked by another customer.

4. Should weather conditions be deemed unfavourable (upon mutual agreement between Lunar Photography and the customer), photo shoots may be rescheduled to suit both parties. This is due to expensive equipment not being waterproof and the adverse affect on the quality of the photo shoot. Any concerns regarding the weather will be communicated as soon as possible. There is no extra charge for rescheduling for this reason. If the weather is unfavourable and we agree to go ahead with the photo shoot, there is no guarantee for the quality of the photos.

5. Rescheduling for reasons other than unfavourable weather, illness, loss of life to you or your horse/dog will incur a £30 rescheduling fee.

6. If you need to reschedule for any other reason, please let me know no later than 7 days before your photo shoot, failure to do this will incur a £30 rescheduling fee.
